EAJ-FUND
EAJ maintains a provident fund whose object consists in assisting judges and prosecutors who are suspended, detained or otherwise prosecuted by state organs because of the exercise of their functions. Assistance may be given to judges and prosecutors from countries whose associations of judges or associations of judges and prosecutors are members of the European Association of Judges (EAJ).
On the request of a judge or prosecutor or the national Association of Judges or Association of Judges and Prosecutors the costs of a counsel for the defense/defense attorney and other necessary costs for the proceedings can be taken over wholly or partially by the fund.
Approval may be given if the committee of the fund is persuaded, that the prosecution of the judge or prosecutor which is based on a decision or the exercise of the office, is neither a willful misuse of the duties nor element of an other crime like corruption nor perversion of justice, but is an attempt to infringe the independent exercise of the judge´s or prosecutor’s office.
In excess to the costs of proceedings the fund may also make payments for the maintenance of the family of the judge or prosecutor for a length of time of three months. For this a request of a member of the family is necessary in which the financial emergency is represented. The request will be dealt with by the committee of the fund. In special cases it can prolong the payment of the maintenance.
